Terms and Conditions

These Terms and Conditions govern the supply of custom-manufactured vinyl records, CDs, cassettes, and associated services by Fusion Audio Mastering. By placing an order, you agree to be bound by the terms set out below.

1. Service Description

Fusion Audio Mastering provides bespoke manufacturing services for physical audio media including lathe-cut vinyl records, CDs, and cassettes. All products are manufactured to order using audio and/or artwork supplied by the customer unless otherwise agreed in writing.

Fusion Audio Mastering acts solely as a manufacturing and technical service provider and does not act as a publisher, distributor, or licensor of any submitted material.

2. Customer Responsibility and Copyright Warranty

By placing an order, you confirm and warrant that:

  • You have obtained all necessary permissions and licences from the relevant copyright, publishing, and master rights holders for any submitted audio or artwork.

  • You have the legal authority to reproduce, modify, and manufacture the submitted materials.

  • The manufacture of the requested items does not infringe the intellectual property rights of any third party.

Fusion Audio Mastering acts solely as a manufacturing service provider and does not directly negotiate or grant third-party copyright permissions on behalf of the customer.

2.1 Sourced Audio via Corporate Licensing (LM Scheme Boundaries)

Where Fusion Audio Mastering relies on its corporate MCPS/PRS Limited Manufacture (LM) licence framework to legally source and clear commercial tracks on behalf of the customer:

  • This framework strictly applies only to audio tracks registered within the collective management database.

  • The Single-Artist Limit: In compliance with standard UK LM licensing terms (Clause 3.3), no single individual product (e.g., custom vinyl, CD, or cassette) may contain more than two (2) tracks featuring the same artist. Orders attempting to exceed this database limit will be automatically rejected or amended.

  • This automated blanket licence applies strictly to private, domestic, and personal use (such as home playback, gifts, or private keepsakes). The physical product carries no commercial exploitation, public performance, or resale rights.

2.2 User-Uploaded Audio & Intellectual Property Indemnity

Where the customer manually uploads, submits, or provides their own audio files to fill physical media running times (bypassing automated database tracks):

  • Fusion Audio Mastering acts purely as a passive, custom duplication/manufacturing house.

  • The customer assumes 100% legal liability and certifies that they hold the correct master rights, mechanical replication rights, or are executing a lawful private backup right under applicable copyright exceptions.

2.3 Intellectual Property Restraints on Visual Artwork

While specific audio tracks can be cleared and royalty-paid under collective blanket licensing systems, visual artwork, graphics, and logos cannot.

  • Fusion Audio Mastering will absolutely not print copyrighted album art, trademarked imagery, celebrity photographs, or corporate logos without explicit, documented proof of permission from the intellectual property owner.

  • The customer must supply their own original images or text. Fusion Audio Mastering reserves the right to reject any artwork submission deemed to violate third-party copyright or trademark laws.

2.4 Indemnification Clause

You agree to fully indemnify, defend, and hold harmless Fusion Audio Mastering against any and all claims, damages, liabilities, losses, or legal costs (including legal fees) resulting directly or indirectly from the reproduction, printing, or manufacturing of any audio materials or visual artwork submitted or requested by you.

3. Custom-Made Goods

All products are made to the customer’s individual specifications and are classified as custom-made goods under the Consumer Contracts Regulations 2013.

As such:

• The statutory 14-day cancellation right does not apply
• Orders cannot be cancelled once production has commenced

Production is deemed to have commenced once audio preparation, artwork preparation, scheduling, or manufacturing setup has begun.

4. Order Amendments

Requests for order amendments or cancellation must be submitted within 24 hours of placing the order.

Fusion Audio Mastering reserves the right to refuse amendment or cancellation requests submitted after this period, particularly where production scheduling or preparation has begun.

Once production has commenced, no amendments or cancellations will be accepted.

5. Submitted Materials

Customers are solely responsible for the accuracy, legality, and technical suitability of all submitted materials.

Fusion Audio Mastering is not responsible for:

• Spelling errors or design errors in submitted artwork
• Audio defects present in supplied files
• Editing errors, fades, clipping, distortion, or file gaps
• Playback issues arising from source material quality

Unless a separate mastering or design service is agreed in writing, submitted files will be used as received.

6. Audio Playback and Manufacturing Limitations

Custom lathe-cut vinyl records and other analogue formats may exhibit inherent characteristics of the manufacturing process.

Fusion Audio Mastering is not responsible for:

• Lead-in or lead-out position or length
• Minor surface noise
• Variations in volume or EQ
• Custom lathe-cut records not aligning or cueing correctly with automatic or semi-automatic turntables
• Playback issues caused by the customer’s turntable or audio equipment

Such characteristics do not constitute a manufacturing fault.

7. Personal Use

Unless otherwise agreed in writing, all items produced are intended for personal use only and must not be resold, distributed, or commercially exploited by the customer.

If you are the copyright and master rights holder of the submitted audio content and wish to manufacture items for resale or commercial distribution, this may be permitted where expressly agreed in writing with Fusion Audio Mastering prior to production commencing. Any such agreement may be subject to additional licensing verification or manufacturing terms.

8. Faulty Items

Where a manufacturing fault is identified, Fusion Audio Mastering will offer a replacement or refund in accordance with the Returns Policy.

9. Shipping and Delivery

Estimated production and delivery times are provided for guidance only and are not guaranteed.

Fusion Audio Mastering shall not be held liable for delays caused by third-party couriers or circumstances beyond reasonable control.

10. Limitation of Liability

Fusion Audio Mastering’s liability shall be limited to the value of the goods supplied.

Fusion Audio Mastering shall not be liable for:

• Indirect or consequential losses
• Loss of income or opportunity
• Equipment damage caused during playback

11. Promotional Use

Fusion Audio Mastering reserves the right to photograph, film, or otherwise record the production process and final manufactured products for use in promotional materials, including but not limited to website content, social media platforms, advertising, and product listing examples.

By placing an order, you grant Fusion Audio Mastering a non-exclusive, royalty-free licence to use images or recordings of the manufactured items for promotional and portfolio purposes.

No personal customer information will be disclosed without prior consent. Customers who do not wish their order to be used for promotional purposes must notify Fusion Audio Mastering in writing prior to production commencing.

12. Changes to Terms of Service

Fusion Audio Mastering reserves the right to update, change, or replace any part of these Terms of Service at its sole discretion by posting updates to our website. It is your responsibility to review these Terms and Conditions periodically for changes.

Continued use of our services following the posting of any changes constitutes acceptance of those changes.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
